Student Records and Privacy

Records of students’ grades, competencies, behavior, etc., are retained at MCTEC for the time the student is attending. The privacy of these records is assured and information contained in them will not be divulged to unauthorized individuals or agencies. The collection, maintenance, and disclosure of these records will be in accordance with guidelines established by the West Virginia Department of Education and the Mercer County Board of Education, and the Council for Opportunity in Education.

The Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. § 1232g; 34 CFR Part 99) is a Federal law that protects the privacy of student education records. The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education.

FERPA gives parents certain rights with respect to their children's education records. These rights transfer to the student when he or she reaches the age of 18 or attends a school beyond the high school level. Students to whom the rights have transferred are "eligible students." Directory Information

Schools may disclose, without consent, "directory" information such as a student's name, address, telephone number, date and place of birth, honors and awards, and dates of attendance.   If an eligible student chooses to not have your directory information released, the eligible student must submit a request in writing to the Student Services Facilitator.

Once the request is received, student information will not be released for any reason (such as enrollment verification for employment purposes).

Record Location and Preservation

Individual student progress records are kept locked in their instructor's classroom.  Students have the right to view their records at any time.

Official records are kept in the main office.  Electronic record keeping is kept by password by the Student Services Facilitator, and is backed up in cloud storage.
